SHELBY COMMUNITY IMPROVEMENT CORPORATION, INC.
On November 4, 1991, the Shelby Community Improvement was formed under Shelby Council Resolution 63-91. Ordinance No. 3-2005 repealed this resolution and was passed by Shelby City Council on February 22, 2005. Ordinance 3-2005 reads:
ENACTING CHAPTER 856 (COMMUNITY IMPROVEMENT CORPORATION) OF THE CODIFIED ORDINANCES OF THE CITY OF SHELBY, AND REPEALING RESOLUTION NO. 63-91.
WHEREAS, On November 4, 1991, Council passed Resolution No. 63-91, "A Resolution Designating the Community Improvement Corporation of Shelby, Ohio, as a Community Improvement Corporation for the City of Shelby", and
WHEREAS, Because said Resolution contained language granting certain powers to the Mayor, it is in the interest of the public health, safety, morals and general welfare of the City that said language be codified.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL FOR THE CITY OF SH ELBY, OHIO, A JAMORITY ELECTED THERETO CONCURRING:
Section 1: That Chapter 856 of the Codified Ordinances of the City of Shelby be enacted to read as follows:
CHAPTER 856
Community Improvement Corporation
856.01 DESIGNATION
Community Improvement Corporation of Shelby, Ohio, Inc. (hereinafter referred to as "CIC") is hereby designated as the community improvement corporation for the City of Shelby in accordance with Ohio Revised Code Section 1724.10.
856.02 MAYORAL APPOINTMENTS
The Mayor is hereby authorized to appoint to the governing board of CIC such members as may be designated to represent the City on said board.
856.03 PREPARATION OF A PLAN
CIC is hereby authorized and directed to prepare a plan in consultation with the officials of the City for industrial, commercial, distribution, and research development for the City in accordance with the powers prescribed in Ohio Revised Code Section 21724.10(A) and to submit said plan to the Council for its consideration.
856.04 MEETINGS
(1) The governing board of CIC shall meet not less than quarterly.
Section 2: That Resolution No. 63-91 shall be and is hereby repealed.
Section 3: That all meetings and hearings concerning the adoption of this Ordinance have been in compliance with Codified Ordinance 220.01, Ohio Revised Code Section 121.22, and the Charter of the City of Shelby, Ohio.
Section 4: That this ordinance is hereby deemed to be an emergency so as to meet the ongoing contractual obligation of the City of Shelby, Ohio, and therefore, shall be in full force and effect from and after its passage, approved by the Mayor, and the earliest period allowed by law.
